Free Trial Terms and Conditions
1. Acceptance of terms and conditions
These terms and conditions of service (‘terms’) are the only terms and conditions that apply to your use of the video collaboration platform service (‘services’) during a free trial period. The service is provided by The Service Provider (the Provider).
The Service Provider (the Provider) reserves the right to change the terms from time to time. By using any part of the service at any time you agree to be bound by the most current version of the terms. If you do not agree to the terms, then you may not access the site or use this service. As long as you comply with these terms, The Service Provider (the Provider) grants you a non-transferable limited right to use the service.
2. Your account and use of the service
You are responsible for any and all activities that occur using the account that you set up including those of any
employees, contractors or agents introduced to the service by you. You must keep details of your account and
password confidential and you agree to notify The Service Provider (the Provider) promptly if you suspect unauthorised access has occurred or a breach of your account has taken place. You may be held liable for losses incurred by The Service Provider (the Provider) and/or any other party and agree to indemnify The Service Provider (the Provider) should losses occur due to a third party using your account or password.
3. Your account
You agree to be solely responsible for the content created, transmitted and displayed while using the service.
The Service Provider (the Provider) reserves the right to immediately close any account and remove you as a user if inappropriate activity or content is suspected at any time. You acknowledge that The Service Provider (the Provider) may access, use, preserve, or disclose information about you and your account if legally required to do so or if The Service Provider (the Provider) believes that such access or disclosure is reasonably necessary to comply with a legal process or request; to enforce these terms; to detect or prevent fraud, security, or technical issues; or to protect the rights, property or safety of The Service Provider (the Provider), its users or the public

While The Service Provider (the Provider) will provide support from time to time for the service, it is not obligated to provide any maintenance, technical or other support to you as a customer of The Service Provider (the Provider) or as a user of the service during a free trial unless otherwise stipulated in a bespoke contract of service.
6. Acceptable use policy
You agree not to use the service in a manner that (a) abuses or materially disrupts any aspect of the service or
The Service Provider (the Provider)-related services and products (b) interferes with the use of the service by other users; (c) generates or facilitates unsolicited communications; and/or (d) violates or facilitates the violation of the legal rights of others. You will not use the service for fraudulent or illegal purposes, including the storage or transmission of content infringing the intellectual property rights of others, or to communicate any message or material that is deemed harassing,
threatening, indecent, obscene, slanderous, defamatory, or otherwise unlawful. You are solely responsible for all data
and materials (‘content’) that you stream or communicate via the service. The Service Provider (the Provider) reserves the right to investigate and take appropriate legal action against anyone who, in The Service Provider (the Provider)’s sole discretion, violates this provision.
Unless otherwise expressly authorised by The Service Provider (the Provider) you agree not to display, distribute, license, perform, publish,reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or transmit for any commercial purposes any portion of the service, use of the service, or access to the service.
7. Data transmission charges and equipment
You are responsible for all fees and charges imposed on you by telephone carriers, wireless providers and other data
transmission providers used by you to access and use the service, if any. You will also be responsible for providing any
equipment and ancillary services (including fees for those services) needed to connect to, access or otherwise use the
The Service Provider (the Provider) service. This includes video-enabled devices, servers, software, operating systems, internet and telephone service (“equipment)
You hereby acknowledge that The Service Provider (the Provider) owns all legal rights, titles and interests in and to the service including any intellectual property rights which subsist in the service (whether or not those rights are registered and wherever in the world those rights may exist). You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or
documentation, or create or attempt to create a substitute or similar service or product through use of or access to
the service or proprietary information related thereto. You shall not use or register (or attempt to register) any
trademarks (including domain names) that are derived from or confusingly similar to those of The Service Provider (the Provider.
9. Termination of account
You may stop using the service at any time. The Service Provider (the Provider) reserves the right to discontinue provision of the service or restrict access at any time in its sole discretion with or without notice to you. You agree that The Service Provider (the Provider) may suspend or terminate your account for any reason, including, without limitation, for lack of use or if The Service Provider (the Provider) believes that you have violated or acted inconsistently with the letter or spirit of these terms. The Service Provider (the Provider) may also at its sole discretion and at any time discontinue providing the service. You agree that any termination of your access to the service may be effected without prior notice, and acknowledge and agree that The Service Provider (the Provider) may immediately deactivate or delete your account. You agree that The Service Provider (the Provider) will not be liable to you or any third party for any termination of
your access to the service.
10. Disclaimer of warranties
You hereby agree that the service provided by The Service Provider (the Provider) may contain bugs, errors, and other defects. Your accessto and/or use of the service and/or linked sites is at your sole risk. To the extent permitted by applicable law, The Service Provider (the Provider) expressly disclaims all and you receive no warranties and conditions of any kind, whether express or implied, including, but not limited to, those of merchant ability, satisfactory quality, title, fitness for a particular purpose and non-infringement. The Service Provider (the Provider) makes no warranty that any of the services will meet your requirements and/or that the services will be uninterrupted, timely or error-free, nor does The Service Provider (the Provider) make any warranty as to the results that may be obtained from the use of the services or the accuracy of any other information obtained through the services or that any defects in the services will be corrected. The Service Provider (the Provider) makes no warranties or guarantees regarding the security of the services.
You assume all risks and all costs associated with your use of the services, including, without limitation, any internet
access fees, back-up expenses, costs incurred for the use of your device and peripherals, and any damage to any
software, information, data or equipment. You understand and agree that any material and/or data downloaded or
otherwise obtained (including plug-ins) through the use of any of the services is at your own risk and that you will be
solely responsible for any damage to your computer system and/or loss of data that results from the download of such
material and/or data. No information or advice, whether oral or written, obtained by you from The Service Provider (the Provider) or through the services shall create any warranty not expressly made herein. Some jurisdictions do not allow the exclusion of certain warranties and conditions, so some of the above exclusions may not apply to you.
There are no fees associated with use of the service in connection with the free trial of the service. However, unless
otherwise stipulated by virtue of the fact you are taking part in a free trial and to the extent that The Service Provider (the Provider) makes the service available to you then you will have to select a payment plan and provide information to The Service Provider (the Provider) about how you will pay for the service. You agree to pay The Service Provider (the Provider) an amount specified in a payment plan and authorise The Service Provider (the Provider) to bill your payment instrument in advance on a periodic basis in accordance with the terms of the applicable payment plan until you terminate your account. We reserve the right to change The Service Provider (the Provider)’s prices. If prices do change then The Service Provider (the Provider) will provide notice of the change at least 30 days before the change is to take effect. Your continued use of the service after a price change constitutes your agreement to pay the changed amount.
You agree to hold harmless and indemnify The Service Provider (the Provider) from and against any third party claim arising from or in any way related to (a) your breach of these terms, (b) your use of the service, (c) your violation of applicable laws, rules or regulations in connection with the service or (d) your user content, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgements, litigation costs and fees of every kind and nature.
You agree to comply with all applicable local, state, national and foreign laws, rules, and regulations applicable to your
use of the service.
14. General terms and conditions of use
disputes or claims not subject to arbitration, as set forth above, you and The Service Provider (the Provider) agree to submit to the personal and exclusive jurisdiction of the English Courts. The failure of The Service Provider (the Provider) to exercise or enforce any right or provision of these terms will not constitute a waiver of such right or provision. The section titles in these terms are for convenience only and have no legal or contractual effect. Notices to you may be made via either email or regular mail or via links to a notification of a change in terms hosted on a The Service Provider (the Provider) operated website.
